After the documents have been successfully verified, the registrar will publish your brand name in the Indian Trade Mark Journal. You can start using the symbol ‘TM’ in your brand name. This is certainly the most important part of the trademark registration and there should not be any opposition within 3 months (i.e. 90 days) or 120 days, in some cases, from the date of publication. The Registrar will accept your trademark application if there’s no opposition and issue a Trademark Certificate. Post which you can start using the Ⓡ in your brand name or logo.

Upon approval, the trademark registry issues a trademark registration certificate, officially confirming and protecting your registered trademark. The registration remains valid for 10 years from the application filing date, with the option for indefinite renewal thereafter. This process ensures the enduring protection of your brand identity.

Frequently Asked Questions
The Trademark Registry has classified goods and services under 45 classes. Each class lists a host of goods/services and depending on those you are offering, you need to mention the class(es) on your trademark application. The trademark would be registered and protected under those classes only.
If your trademark is similar to an existing application, it would hurt religious sentiments, contain geographical names, or common words. It would also be rejected if it is likely to confuse.
As soon as you file the application and receive an acknowledgement, you can use the ™ symbol. Once the registration process is complete, you can use the ® symbol.
If your brand name has already been registered, but under a different class, you may still get it registered. However, if the brand is too well known (like Tata or Boat), your application is likely to be approved.
Accepted trademarks are published in the Trademark journal, allowing public objections. If no objections arise within 90 days, the trademark is registered in 12 weeks.
You can’t get the word, but all is not lost. You could instead design a unique logo for your business and include the name in it. So there is a way out, but it is best to have a unique name.
Many start-up founders register it in their own names, while large businesses would prefer to do so in the name of the company.
A third party may file an objection to trademark registration if it harms their interests. Both parties can present arguments, and a Trademark Hearing Officer decides.
You can appeal decisions to the Intellectual Property Appellate Board if you disagree with the Registrar or Hearing Officers judgment.
